What are your rights as a tenant of a private home?
Tenants of private homes have the same legal protection as tenants of housing associations. Dutch tenant-protection law applies to all rental homes in the Netherlands, regardless of whether the landlord is private or institutional.
- Security of tenure: the landlord cannot simply end the lease
- Rent protection (liberalised sector): annual indexation capped at inflation + 1%
- Maintenance obligation: the landlord is responsible for major maintenance and defects
- Deposit: a maximum of two months'' basic rent
- No double agency fees: estate agent costs may not be passed on to the tenant (the ''Wet van Dam'')
